Overview of State Regulations

          North Dakota has state asbestos regulations which cover sampling requirements, certification of asbestos personnel, landfill disposal of asbestos, etc. The state regulations are more stringent than the federal regulations in certain areas. The state is NESHAP-delegated by the USEPA.

          State/Federal Agencies Involved with the State Asbestos Program

          The following agencies/entities have asbestos-related regulatory and enforcement responsibilities in North Dakota:

          A. The Department of Health, Environmental Health Section, Division of Environmental Engineering (contact phone (701) 328-5188, general phone (701) 328-5150), is involved in the following state/federal asbestos enforcement/requirements:
        • training, personnel - North Dakota's state asbestos training courses are fully approved by the EPA Region 8.
        • certifications, personnel and laboratories
        • licensing, asbestos contractors
        • pre-abatement notifications/approvals
        • NESHAP/demolition/renovation/wet/tag/bag/bury
        • site audits
        • sampling requirements.

          Laboratory Requirements

          There are state-specific accreditation requirements for laboratories and analysts performing asbestos analyses.
