Environmental risk considerations have had a considerable impact on the commercial real estate industry. From pre-acquisition due diligence and qualifying for the "Innocent Landowner Defense", to tenant monitoring and site remediation, risk management has become part of most commercial real estate transactions.
With the USEPA endorsement of risk-based decision making for certain corrective action programs, and the implementation of voluntary cleanup and Risk-Based Corrective Action (RBCA) programs in many states, property owners and commercial real estate professionals are faced with new opportunities and challenges.
