Overview of State Regulations

          West Virginia has written their own asbestos regulations, West Virginia Health Code 1632. The state uses the federal NESHAP regulations also.

          State/Federal Agencies Involved with the State Asbestos Program

          The following agencies/entities have asbestos-related regulatory and enforcement responsibilities in West Virginia:

          A. The West Virginia Division of Environmental Protection, Office of Air Quality (general phone (304) 558-4022) is involved in the following state/federal asbestos enforcement/requirements:
        • pre-abatement notifications/approvals
        • review of abatement designs
        • NESHAP/demolition/renovation/wet/tag/bag/bury
        • site audits/inspections.

          B. The West Virginia Bureau of Health, Office of Environmental Health Services, Radiation, Toxics, and Indoor Air Division (contact phone (304) 558-0697, general phone (304) 558-2981) is involved in the following state/federal asbestos enforcement/requirements:
        • training courses - Presently, the state training course program for asbestos personnel is not approved by the EPA Region 3. Full approval is expected by July 1, 1998.

          E. The OSHA Region 3 (general phone (215) 596-1201) is involved in the following federal asbestos enforcement/requirements:
        • OSHA/worker safety/medical surveillance
        • site audits/inspections.

          Laboratory Requirements

          There are no state-specific accreditation requirements for laboratories and analysts performing asbestos analyses.

          Federal regulations require laboratories and analysts performing asbestos analyses to be properly accredited. Contact the two following organizations for accreditation information:
